By making payment to Your London Memories ("we/us") and downloading your photos, you agree to the following terms and conditions:
The edited images will be provided to you in digital form for download. We will not provide any physical prints.
The photographs will be available for you to download for a period of 2 weeks following payment. After this 2 week period, we will retain the photographs for a further period of 6 months and you may contact us to ask that the photographs be made available again for downloading. After this further period of 6 months, we are under no obligation to retain the photographs or make them available again for downloading.
We retain full control over all artistic decisions made in relation to the photographs.
Copyright in all images is retained worldwide by us at all times and nothing shall be deemed as a release, transfer, assignment or other disposal of our rights in the images.
You are granted a licence to use the images for personal use including to copy, share, upload and print the images. The licence does not permit you to sell the images or to use the images for any commercial use or monetary gain.
If you have opted for the publicity discount, you consent to us using your photos on our website(s), social media pages, and all other forms of advertising and marketing materials (whether digital or paper or otherwise), as well as for submission to competitions and awards.
Insofar as permitted by law we exclude liability for any damage to property or injury to the person that might occur during a photoshoot whether by our act or omission or otherwise. All activities during the photoshoot are undertaken at your own risk and we assume no duty of care towards you. Your safety and that of other participants in the photoshoot is your responsibility at all times. All children must be accompanied by a parent, and it is your responsibility to supervise and to attend to your children to ensure their safety at all times.
In the highly unlikely event of a cancellation by us, or unavoidable inability to attend in whole or in part, or equipment failure, or any other failure to deliver photographs following a photoshoot, our liability shall be limited to a full refund of all fees that have been paid. There shall be no liability for non-pecuniary loss including damages for distress, Inconvenience, hurt feelings or upset, loss of enjoyment or other such losses of this nature.
